3. ORDERS

When you place an order, you are making an offer to purchase products from NORÉA.

We reserve the right to accept, decline, cancel or limit any order at our discretion, including where we suspect fraud, unauthorised activity, resale activity, pricing errors, or stock unavailability.

An order is only accepted once payment has been received and we have confirmed the order.

Please review your order carefully before submitting it. We may not be able to accommodate changes or cancellations after an order has been placed.

 

4. PRICES AND BILLING

All prices displayed on the Services are in Australian dollars unless otherwise stated.

Prices, promotions and discounts are subject to change without notice.

Unless otherwise stated, prices do not include shipping charges, customs duties, import taxes or similar charges that may apply to your order.

5. SHIPPING AND DELIVERY

Shipping times provided on the Services are estimates only and are not guaranteed.

We are not responsible for delays caused by postal services, couriers, customs, or events outside our reasonable control.

It is your responsibility to ensure that your shipping details are correct at the time of purchase. We are not responsible for orders delivered to an incorrect address supplied by the customer.

Risk in the products passes to you upon delivery to the address provided in your order, to the extent permitted by law.

 

6. RETURNS, REFUNDS AND EXCHANGES

All purchases are subject to our Refund Policy.

We do not offer returns or refunds for change of mind. This includes returns based on scent preference, fragrance strength, or general personal preference.

We only offer a refund, replacement or other remedy where required under Australian Consumer Law or where an item arrives faulty, damaged, or incorrect.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under Australian Consumer Law that cannot be excluded, restricted or modified by agreement.

 

7. PRODUCT USE AND SAFETY

Candles and other home fragrance products must be used in accordance with all care and safety instructions provided with the product.

You are responsible for using our products safely and appropriately. To the maximum extent permitted by law, NORÉA is not responsible for loss, damage or injury caused by misuse, improper storage, failure to follow safety instructions, or use of products in an unsafe manner.

 

8. INTELLECTUAL PROPERTY

All content on the Services, including our business name, brand elements, logos, text, graphics, images, product names, product descriptions, designs and other materials, is owned by or licensed to NORÉA and is protected by applicable intellectual property laws.

You may use the Services for your personal, non-commercial use only. You must not reproduce, copy, distribute, republish, sell, exploit or otherwise use any part of the Services without our prior written consent.

11. RELATIONSHIP WITH SHOPIFY

NORÉA is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with NORÉA.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and NORÉA, including any injury, damage, or loss resulting from products or services purchased from NORÉA.

You hereby release Shopify and its affiliates from claims, damages and liabilities arising from or related to your purchases and transactions with NORÉA.

All personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted by Shopify, Shopify may also collect and process personal information in accordance with its own privacy practices.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under Australian Consumer Law or any other applicable law that cannot be excluded.

 

19. INDEMNITY

You agree to indemnify and hold harmless NORÉA, its affiliates, service providers, and Shopify and its affiliates, from any claim, demand, loss, liability or expense arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.

 

20. SEVERABILITY

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

 

21. WAIVER AND ENTIRE AGREEMENT

If we do not enforce a right or provision under these Terms, that does not constitute a waiver of that right or provision.

These Terms, together with any policies referenced in them, constitute the entire agreement between you and NORÉA regarding your use of the Services.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations under these Terms at any time without notice.

 

23. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia.

You agree to submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.
